Terms of Service

1. Eligibility

You must be at least 13 years old to use Takeoff. If you are under 18, you represent that you have permission from a parent or legal guardian.

2. Account Registration

You may create an account using:

• Email and password
• Social authentication providers

You agree to:

• Provide accurate and current information
• Maintain the security of your credentials
• Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Description of the Service

Takeoff enables users to:

• Create and manage trips with destination search
• Add and vote on recommendations ("Picks")
• Maintain a personal Picks library ("My Picks") independent of trips
• Organize Picks into day-by-day itineraries
• Collaborate with others, including anonymous contributors
• Generate AI-powered itineraries and recommendations
• Extract travel recommendations from social media video URLs (TikTok, Instagram)
• Discover alternative place recommendations powered by AI
• Share trips publicly via short links (tkff.to)
• Export trip dates to your device calendar
• Export trip data as CSV files
• Store travel documents (Premium feature)
• Access trips offline via local storage
• Access premium features through paid subscriptions

Features may change over time.

4. User Content

4.1 Content You Provide

You may submit content including:

• Trip details
• Picks, notes, and comments
• Votes and preferences

You retain ownership of your content. By submitting content, you grant Rally a non-exclusive, worldwide, royalty-free license to host, store, display, and process that content solely for operating and improving the Service.

4.2 Anonymous Contributions

Some features allow anonymous participation. You acknowledge that:

• Anonymous content may still be associated internally with technical identifiers
• Rally does not guarantee anonymity against legal requests or abuse investigations

4.3 Video URL Extraction

Takeoff allows you to submit video URLs from supported platforms (TikTok, Instagram) to extract travel recommendations. By submitting a URL, you:

• Represent that you have the right to share the URL
• Acknowledge that the content is processed by AI to identify travel-related places
• Understand that extracted information may be inaccurate or incomplete
• Accept that we do not guarantee availability of this feature for all URLs

We do not store the video content itself; only the URL and extracted place information are processed.

4.4 Trip Documents

Premium users may upload documents (confirmations, tickets, reservations) to trips. You agree:

• To upload only documents you own or have rights to store
• Not to upload documents containing sensitive information of others without consent
• That documents are limited to 25 per trip, with a maximum size of 10MB each
• That supported formats include PDF, JPG, PNG, and HEIC files
• That documents are accessible only to the trip owner

Rally is not responsible for document accuracy, validity, or your reliance on stored documents for travel purposes.

5. AI-Generated Content

Certain features generate content using artificial intelligence ("AI Content"), including:

• Smart Itineraries based on trip preferences
• Alternative place recommendations
• Video URL extraction and place identification
• Day optimization for efficient routing

5.1 Third-Party AI Services

We may use third-party AI providers to generate recommendations. These services may process trip context, preferences, and pick information to provide relevant suggestions.

5.2 Limitations

You acknowledge:

• AI Content is generated automatically and may be inaccurate or incomplete
• AI Content is for informational and planning purposes only
• Rally makes no guarantees regarding accuracy, availability, pricing, or suitability
• Recommendations may not reflect current business hours, pricing, or availability
• AI-extracted places from videos may not match the original content creator's intent

You remain responsible for verifying bookings, reservations, and travel plans independently.

6. Premium Subscriptions

6.1 Takeoff Pro

Takeoff offers optional paid subscriptions ("Takeoff Pro") that unlock premium features.

Subscriptions:

• Are billed via the App Store or Play Store
• Automatically renew unless canceled
• Can be managed through your device account settings

Payments are processed by third-party providers (e.g., Apple, Google). Rally does not store your payment credentials.

6.2 No Refunds

All purchases are final, except as required by law or platform policy.

7. Offline Features & Local Storage

7.1 Offline Mode

Takeoff allows you to download trip data for offline access. Downloaded data is stored locally on your device using SQLite database technology.

7.2 Calendar Sync

You may export trip dates and itinerary events to your device calendar. This requires granting calendar access permissions. Rally does not access other calendar data beyond what is necessary to create trip events.

7.3 Data Export

Premium users may export trip data as CSV files. Exported data is generated on-demand and is not stored by Rally after export.

7.4 Local Data Responsibility

You are responsible for:

• Managing local storage space on your device
• Backing up exported data as needed
• Understanding that offline data may become outdated
• Syncing changes when connectivity is restored

8. Acceptable Use

You agree not to:

• Post unlawful, harmful, or abusive content
• Impersonate others
• Attempt to reverse engineer the Service
• Abuse voting, sharing, or AI systems
• Interfere with Service integrity or security

We may remove content or restrict access at our discretion.

9. Third-Party Services

The Service integrates third-party services, including:

9.1 Place & Image Data

• Location and place data services (search, details, photos)
• Image services (fallback images for trips and destinations)
• Mapping providers

9.2 AI & Content Services

• AI services for alternative place recommendations
• Video content analysis for URL extraction

9.3 Infrastructure & Payments

• Authentication, database, and file storage providers
• Subscription management providers
• App Store and Play Store (payments)
• Analytics and infrastructure providers

9.4 Social Platforms

• Social media platforms (video URL processing for extraction feature)
• Social sharing platforms

We are not responsible for third-party services, their availability, or content. Third-party services are subject to their own terms and privacy policies.

10. Intellectual Property

All intellectual property rights in the Service—including software, design, branding, and logos—are owned by Rally App, Inc. or its licensors.

You may not copy, modify, or distribute any part of the Service without permission.

11. Termination

You may stop using Takeoff at any time.

We may suspend or terminate your access if:

• You violate these Terms
• Required by law
• Necessary to protect the Service or users

Termination does not affect accrued rights or obligations.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY OF AI-GENERATED OR USER-SUBMITTED CONTENT

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RALLY SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
• LOST PROFITS, DATA, OR GOODWILL
• TRAVEL DISRUPTIONS OR BOOKING ERRORS

TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO RALLY IN THE PRECEDING 12 MONTHS.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

15. Changes to These Terms

We may update these Terms from time to time. Continued use after updates constitutes acceptance.
